Special Town Meeting Minutes 12/6/05
Pursuant to the foregoing warrant, a Special Town Meeting was called on December 6, 2005, 7:00 p.m. at Becket Town Hall, 557 Main Street, Becket.  There being a quorum present, the meeting was called to order at 7:03 p.m. by the Moderator.  There were 34 voters present.  

Present:  Bruce Garlow, Moderator; William Cavanaugh, John Murray and Doug Walter, Selectmen; Michael Falk and Richard Pryor, Finance Committee Members; Jeanne Pryor, Town Clerk; and Richard Furlong, Town Administrator.   

The Moderator opened the meeting stating the rules to be followed.  Town Clerk, Jeanne Pryor, read the call of the meeting and officer’s return of service and the Moderator noted the warrant as having been duly posted.  The following articles were voted on:

Article 1: To see if the Town will approve borrowing the sum of $250,000.00 to defray the cost of emergency road repairs following the storm of October 8, 2005.  This will be in anticipation of receiving emergency money from Massachusetts Emergency Management or Federal Emergency Management Agencies or from any other source.

Article 1 was moved by Martin Schlanger and seconded on the floor.  There was no discussion.
Article 1 passed unanimously.

Article 2: To see if the Town will vote to authorize the Selectmen to petition the General Court for special legislation to amend Chapter 31 of the Acts of 1997, AN ACT ESTABLISHING THE SHERWOOD GREENS ROAD IMPROVEMENT AND MAINTENANCE DISTRICT IN THE TOWN OF BECKET, with said amendments to become effective upon passage by the Legislature, as follows:

Amend SECTION 2 (a) by adding the words “all common areas” as follows:

to upgrade, repair and maintain, including snow and ice removal, the streets and ways within the district and all common areas located within the district, or such portions thereof, as the district shall determine in accordance with this act;

Amend SECTION 1 by adding the following section 6:

6. The following parcel and lakes, and any other common area that may be acquired by the district, and the improvements thereon, if any, or other such improvements that may be added from time to time in accordance herewith, constitute the common areas of Sherwood Greens, and shall be maintained by the district for the benefit of all members of the district:

(a)     Entranceway, Map 213, Lot 126 (0.12 acre) on Jacobs Ladder Road, Becket, Massachusetts, as shown on Plan recorded in the Berkshire Middle District Registry of Deeds in Book 3065, Page 145;

(b)     Longbow Lake (25 acres) as shown on Plan recorded in the Berkshire Middle District Registry of Deeds as Sec 15 in Book 417-7, Page 158

(c)     Little Longbow Lake (3 acres) as shown on Plan recorded in the Berkshire Middle District Registry of Deeds as Sec 15 in Book 417-7, Page 158

(d)     Silver Shield Lake (11 acres) as shown on Plan recorded in the Berkshire Middle District Registry of Deeds as Sec 52 in Book 417-F, page 159

(e)     Golden Fawn Lake (3 acres) as shown on Plan recorded in the Berkshire Middle District Registry of Deeds as Sec 11 in Book 417-F, Page 158-A

Article 2 was moved and seconded on the floor.  There was no discussion.  Article 2 passed unanimously.

Article 3: To see if the Town will vote to accept as gifts the following parcels of land:

A.      Map 215, Lot 6 (0.36 acre), located on Olde Carriage Road from the owner Carmelina Kosarko.  Recorded at the Berkshire Middle District Registry of Deeds in Book 1016, Page 880.
B.      Map 215, Lot 8 (0.28 acre), located on Arrowhead Lane from the owner David Wadanoli.  Recorded at the Berkshire Middle District Registry of Deeds in Book 969, Page 379.
C.      Map 215, Lot 48 (0.51 acre), located on Blacksmiths Path from the owner Salvatore Rapacciuolo.  Recorded at the Berkshire Middle District Registry of Deeds in Book 851, Page 391.
D.      Map 215, Lot 70 (0.26 acre), located on Robin Hood Lane from the owner David Wadanoli.  Recorded at the Berkshire Middle District Registry of Deeds in Book 969, Page 376.
E.      Map 217, Lot 206 (0.25 acre), located on King Richard Drive from the owner Annette Hagele.  Recorded at the Berkshire Middle District Registry of Deeds in Book 945, Page 313.

Article 3 was moved by Robert Bellavance and seconded on the floor.  Richard Furlong made a motion to amend the article by adding the following:

F.      Map 215, Lot 45 (0.51 acre), located on Blacksmiths Path from the owner Henrietta Gill.  Recorded at the Berkshire Middle District Registry of Deeds in Book 845, Page 356.

The motion to amend was seconded by William Cavanaugh.  There was no discussion and the motion to amend passed unanimously.  A vote was taken on the amended Article 3.  There was no discussion.  Article 3 as amended passed unanimously.

Article 4: To see if the Town will vote to declare the following town owned properties as surplus and direct the Board of Selectmen to sell these parcels at a sealed bid sale at their discretion:

A.      Map 215, Lot 6 (0.36 acre), located on Olde Carriage Road.  Recorded at the Berkshire Middle District Registry of Deeds in Book 1016, Page 880.
B.      Map 215, Lot 8 (0.28 acre), located on Arrowhead Lane.  Recorded at the Berkshire Middle District Registry of Deeds in Book 969, Page 379.
C.      Map 215, Lot 48 (0.51 acre), located on Blacksmiths Path.  Recorded at the Berkshire Middle District Registry of Deeds in Book 851, Page 391.
D.      Map 215, Lot 70 (0.26 acre), located on Robin Hood Lane.  Recorded at the Berkshire Middle District Registry of Deeds in Book 969, Page 376.
E.      Map 217, Lot 206 (0.25 acre), located on King Richard Drive.  Recorded at the Berkshire Middle District Registry of Deeds in Book 945, Page 313.

Article 4 was moved and seconded on the floor.  Richard Furlong made a motion to amend the article by adding the following:

F.       Map 215, Lot 45 (0.51 acre), located on Blacksmiths Path.  Recorded at the Berkshire Middle District Registry of Deeds in Book 845, Page 356.

The motion to amend was seconded by William Cavanaugh.  There was no discussion and the motion to amend passed unanimously.  A vote was taken on the amended Article 4.  There was no discussion.  Article 4 as amended passed unanimously.

A motion to adjourn was moved and seconded on the floor.  The motion passed unanimously and the meeting was adjourned at 7:11 p.m.  The checkers were Election Officers Bonnie Falk and Maryellen Lake.
